مجازات های جایگزین حبس و تاثیر آن بر کاهش جرم

 

شاه صاحبی در گفتگو با خبرنگار خبرگزاری جمهوری اسلامی (ایرنا)    

در قانون مجازات اسلامی جدید پیش بینی هایی در خصوص تعلیق، تعویق، تخفیف مجازات و آزادی های مشروط بیان شدهاست که به باور کارشناسان، تاثیر بسزایی در کاهش جرم دارد اما به صِرف اتکاء به آن نمی توان از رشد جمعیت کیفری کشور کاست؛

موضوعی که شاه صاحبی با اشاره به آن گفت: بازنگری و اصلاح بعضی قوانین، اجرای نظام نیمه آزادی (تعویق و تعلیق اجرای مجازات و آزادی های مشروط)، قرار دادن مجازات های جایگزین و استفاده از جزای نقدی و محرومیت های اجتماعی به جای حبس نقش مهمی در کاهش جمعیت کیفری و حبس زدایی دارد. شایان ذکر است که اجرای چنین قوانین و دستورالعمل هایی باید با نظارت جدی و همراه با برخوردهای درون سازمانی نسبت به تخلفات انتظامی باشد و ضمنا همواره برای قضات برنامه های بازدید از زندان ها وجود داشته باشد تا خودشان از نزدیک شاهد وضعیت زندان ها باشند و با خانواده زندانیان و وضعیت نابسامان این خانواده ها آشنا و از مشکلات آنها آگاه شوند.
این حقوقدان افزود: یکی از اقدام های اساسی و اصولی دیگر جهت کاهش جرم و در نهایت کاهش تعداد مجرمان و آمار زندانیان، برنامه ریزی های فرهنگی، آموزشی، اقتصادی و اجتماعی و آموزش و پرورش قوی و کارآمدی است که به آموزش مـفاهیم دیـنی و اخلاقی آحاد جامعه توجه بیشتری داشته باشد. همچنین توجه به مسائل اقتصادی جامعه در سطح کلان و وضعیت معیشتی و اشتغال شهروندان هم نقش بسزایی در کاهش جمعیت کیفری خواهد داشت چرا که این موضوع یکی از مهم ترین جنبه های زندگی افراد در اجتماع را شکل داده و بی توجهی به آن، مسائل و معضلات بسیاری را به وجود آورده و سبب افزایش جرم و ناهنجاری های اقتصادی و اجتماعی و در نتیجه افزایش آمار و جمعیت کیفری می شود.
وی در پاسخ به این پرسش که با توجه به آمار تازه منتشر شده از ۱۰ هزار و ۴۰۰ زندانی جرایم غیرعمد، اجرایی شدن بخشنامه تا چه حد موجب کاهش شمار زندانیان و جرایم می شود؟ گفت: به طبع، با توجه به اینکه بخش اعظم زندانیان فعلی را متهمانِ در بازداشت و محکومان به حبس در جرایم غیرعمد و غیره پوشش می دهند، با تسریع و اجرای صحیح قوانین و این مصوبات به نظر می توان شاهد کاهش چشمگیر و قابل توجه آمار زندانیان با سیر نزولی حدود ۲۰ درصد بود.
